About This Project
WHO develop and promote a Model Law on Drug Diversion that codifies the Portuguese Dissuasion Commission structure as an adoptable template, allowing countries to implement health-based diversion from criminal prosecution without full decriminalization — preserving political cover while achieving the institutional outcomes the evidence supports. The model law would establish: a tripartite commission composition (health, legal, social work); referral triggers (possession below defined threshold); commission powers (treatment referral, civil sanction, dismissal — no incarceration); mandatory harm reduction service linkage; and performance metrics aligned with Portugal's documented outcomes. UNAIDS and UNODC co-sponsor as compatible with existing treaty obligations under the 2016 UNGASS outcome document.
